Senate Passes Sunday Liquor Sales 38-28

History Made

Minnesota Senate made history today with a 38-28 vote. The vote would allow, but not require, the sale of liquor, wine, beer and in off-sale establishments in Minnesota. Full language for the bill can be can be found here.

The vote came quickly after the bill passed 7-4 out of Senate Commerce Committee just last week. The Senate debate was not quick. You can watch the entire debate here. The bill passed in a truly bipartisan split. 19 Republicans and 19 Democrats passed Sunday liquor sales out of the Senate 38-28. You can see their votes below.

Now What?

There are some minor differences between the House and Senate bills to legalize Sunday liquor sales. Both versions limit the hours of operation to an 8-hour shift. The Senate version begins 11 am, the House version begins at 10 am. The Senate version also precludes merchandising, sales, and delivery. The differences in the bills can either be settled in a conference committee, or one of the legislative bodies may adopt the language of the other. The contentious debate in the Senate might mean that the House adopting Senate language would be the easiest path to Governor Dayton’s desk. Governor Dayton has stated that he would not veto Sunday liquor sales.

When can Minnesota Consumers buy Spirits, Wine, and Beer on a Sunday?

The differences in the bills need to be worked out, and Governor Dayton needs to allow the bill to become law. Once that happens, Sunday liquor sales would go into effect on July 1st, 2017. Freedom and liberty will taste a little sweeter this Independence Day.

The House passed a bill repealing the Sunday liquor sales ban. The Senate Commerce Committee approved their version with a recommendation to pass it. On Monday, the full Senate will likely hear the bill to repeal the ban on Sunday off-sale liquor sales in Minnesota. LET’S MAKE SURE MINNESOTA CONSUMERS HAVE THE VOTES!

What to do

  • Call and email your Senator and politely ask them to support Sunday liquor sales. Be polite, and let them know you expect a reply with their position. You can find their contact information below. Click HERE if you are not sure who represents you,
  • Let us know if your Senator is voting to repeal the ban on Sunday liquor sales, or if they are representing special interests.
  • Be sure to be polite. Thank your Senator if they plan on representing their constituents by voting yes.

House Speaker Daudt Co-Authors Sunday Liquor Sales Bills

House Speaker Kurt Daudt (R-Crown) and Representative Jenifer Loon (R-Eden Prairie) have introduced legislation to repeal Minnesota’s longstanding ban on off-sale liquor sales on Sundays. The move should come as no surprise. Several legislators made Sunday liquor sales part of their election campaigns. Speaker Daudt has indicated that he thinks a repeal bill could pass the House in the first 30 days of session.

The Bills

The move to modernize the liquor comes as a pair of bills. HF0030 aims at full repeal. HF0031 takes an opt-in / local option approach. Both versions would allow for local control.

The House

The local option approach is likely to resonate with legislators across the aisle from Daudt, as well as within his own caucus. House Minority Leader Melissa Hortman (D-Brooklyn Park) has indicated that she is open to the change and favors local control.

In reality, both bills would allow for local control of Sunday liquor sales. HF0030 would allow municipalities to pass local regulations that are more restrictive than those allowed at the state level. Some could, and likely would, pass noon openings or limited hours. This has always been the case. HF0031 would essentially do the opposite. It would allow municipalities to pass local measures of deregulation. This would also likely result in municipalities with noon openings, limited hours, and full bans still in place.

The Senate

The Minnesota Senate is not as cut and dry as the House of Representatives may appear to be, but there is hope. The large number of new legislators creates a chance for progress on the popular issue. It can be difficult for elected officials to evolve on an issue when they have had a stance several election cycles. New legislators could mean new allies on the issue, but this will only happen if they hear from their constituents. The forces opposed to Sunday liquor sales are probably already whispering in their ears.

New Majority Leader Gazelka (R-Nisswa) has been noncommittal on the issue.

Senator Dahms (R-Rewood Falls) has taken over as the Chair of Commerce and Consumer Protection Finance and Policy Committee. The previous Chair was reluctant to give repeal bills committee hearings while he received considerable donations from the opposition. One can hope that Senator Dahms will be more willing to listen to constituents and turn away donations.

The Governor

Governor Dayton has been on record as supporting Sunday liquor sales for a while now. Linden Zakula, his Deputy Chief of Staff, recently reaffirmed his position via Twitter.

Sunday Liquor Sales to be Voted on in Minnesota House

The Minnesota House of Representatives is scheduled to hear a bill related to liquor wine and beer on Thursday, May 12, 2016. The bill (HF3966) is focused on licensing for the major league soccer stadium in St. Paul, a brewpub in Minneapolis, and others. Rep. Jenifer Loon is likely to  propose an amendment that would give municipalities the option to authorize Sunday liquor sales.

 

(b) Notwithstanding paragraph (a), a municipality may authorize off-sale licensees or a municipal liquor store under its jurisdiction to make off-sales of intoxicating liquor on any day, provided that no sale may be made before 8:00 a.m. or after 10:00 p.m.EFFECTIVE DATE.This section is effective the day following final enactment.

New Poll Shows Sunday Liquor Sales More Popular Than Ever Among Minnesota Voters

A recently released poll from Public Policy Polls (link) shows overwhelming support for Sunday liquor sales from registered voters in Minnesota.

Minnesota voters of all political ideologies believe that Sunday liquor sales should be allowed in the state. Polls show that not only is a repeal of the Sunday liquor ban supported by a majority of voters, but that the issue is gaining momentum.

The growing popularity of Sunday liquor sales proves what we have been saying all summer long as people sign the petition to repeal the ban. With so much backing from people across Minnesota, there will be even more pressure on politicians next year at the Minnesota Capitol to finally pass legislation to lift the outdated ban on Sunday liquor sales.  

In April, both the Minnesota House and Senate failed to pass a bill that would have given liquor stores the option to remaining open on Sundays.  Although both bills were rejected, a law was passed to allow craft breweries to sell beer growlers on Sundays.
Latest polls show there was a 7% increase in overall support from a similar poll conducted in 2014. Republican opinions on the issue of Sunday liquor sales jumped from 52% in 2014 to 60% in 2015.

Minnesotans that identify as Democrats also increased their support for a repeal of the outdated blue law. 69% percent of Minnesota Democrats say they support repealing the prohibition on Sunday off-sale liquor commerce.

The largest increase in support for Sunday sales came from Independent voters in Minnesota. 71% of Independent voters support Sunday liquor sales in Minnesota. This is a large jump from 58% the previous year. Overall, Minnesotans increased their support to modernize the blue law by 7%, bringing support to over 67%.


Sunday growler sales from qualifying breweries have been legalized in many cities across the Minnesota, the sky didn’t fall. Over 7,000 Minnesotans have signed the petition at SundaySalesMN.org, and Minnesotans from every single legislative district have signed the petition to repeal the anti-consumer prohibition on Sunday liquor sales in Minnesota. Support for repealing the ban on Sunday liquor sales should only continue to grow.

Supporters of ending the ban on Sunday alcohol sales will meet at the Minnesota State Capitol this Sunday (3/15) to send a message to legislators that the time has come to stop sending our money over the borders to Wisconsin, the Dakotas, and Iowa; the time has come to end Minnesota’s ban on Sunday alcohol sales.

Meeting at the temporary parking lot on the Capitol Mall, supporters will hear from liquor store owners and craft brewers that are being hurt by this ban. After brief remarks, supporters, unified with custom-made car flags and lights on, will form a caravan to embark on the 19-mile journey to liquor stores in Hudson, Wis., bringing their money with them.

2015 Saint Paul City Council Race and Sunday Liquor Sales

The 2015 Minnesota legislative session has thus far been a busy one with lawmakers introducing several bills aimed at easing the restrictions on Sunday off-sale liquor sales. Bills include everything from a Sunday sales pilot program, to growlers for qualifying brewers, a local option allowing municipalities to lift the ban, and full repeal.

If legislation supporting a local option to allow individual municipalities to lift the ban on Sunday sales were to pass this session, the future of Sunday liquor, beer and wine sales in the city of Saint Paul will be in the hands of its city council members.

With that in mind we reached out to 21 candidates who have announced their intent to run for city council seats across all seven of Saint Paul’s Council Wards. We asked all of the candidates to respond to the following questions:

1. Minnesota Farm Wineries are allowed to sell bottles of wine on Sundays. Should qualifying local brewers be allowed to sell 64 oz / 750 ml growlers of beer on Sundays?
2. Several bills have been introduced to the 2015 state legislature that may ease or repeal the statewide ban on Sunday off-­sale liquor, beer, and wine sales. If the Sunday liquor ban is repealed, would you vote to allow Saint Paul liquor stores to individually choose whether or not to operate on Sundays?

“Yes, I support Sunday growler sales, and I am proud to see the growth of local breweries in Ward 2 and throughout Saint Paul. I want to make sure that Ward 2 is a great environment for small, family-owned businesses that really make up our American dream, and this includes local brewers in our ward like Bad Weather, Great Waters, Tin Whiskers, Vine Park, and Wabasha Brewing. We should work hard to support our local family-owned businesses and not restrict their business with rules that may no longer fit our times.”

We should be doing all we can to encourage and support this burgeoning field; imposing a double-standard does exactly the opposite.”

“I’m excited by the expanding brewing economy in Saint Paul. I understand that this is an issue for consideration by the state legislature and would require a state law change. If that law were to pass, I would support modifying necessary city ordinances to support the small brewing community. Something I believe we can do under current law is change our ordinance to allow growler sales until 10pm on weeknights, I would like to explore that option to encourage development in Saint Paul.”

“Yes. Minnesota’s current blue laws are out-of-date and bad for our local business owners. The City should take steps to ease these restrictions. In Minnesota we have a booming craft beer industry and we should support these entrepreneurs and give Minnesota consumers the option to buy a growler of their favorite brew on a Sunday.”
